I. How is a contract concluded with you
All information on the website is an invitation to treat only. So, the information is not an offer or binding contract. You agree that your order is an offer to purchase the products listed in your order. All orders submitted by you are subject to acceptance by us. We are entitled to verify an order in advance at all times and/or to refuse to accept an order without providing reasons and with no liability to you or any third parties. If we do not confirm acceptance of your order within ten working days, it is deemed to have been refused. We may choose not to accept your order at our own discretion. You can place an offer to purchase by hitting the button "Place order" after completing the following steps:

After placing the order, you will receive an automated email confirming that we have received your binding offer to purchase. Please note that the automated email does not constitute a sales contract. A sales contract is only constituted if SANTA ANA athletic apparel GmbH accepts your offer to purchase by delivering the ordered products or by informing you that the ordered products have been shipped, whichever comes first.

II. Product quality, product care, colour deviations
We shall not be liable for minor colour deviations or any other minor deviations in product quality if it corresponds to market practice. Please observe the washing and care instructions. We shall not be liable for damage resulting from incorrect handling the products and/or not applying the washing and care instructions.

III. Delivery
We ship by DHL. We ship within two business days. From shipping, delivery will take about a week (this might slightly vary depending on your country). Products are released in customary quantities only. In case a product is sold out, we shall immediately inform you and reimburse any payments made. We can only deliver to residential and office buildings.

IV. Damages in transit
The customer undertakes to inform us immediately of any damage incurred during transport by email (sales@santa-ana.co.uk).

V. Warranty
Unless agreed otherwise, the legal warranty regulations will apply.

VI. Prices and delivery charges
The stated prices include VAT. Prices are quoted in Euro. We reserve the right to make price changes prior to an order placed by you. We reserve the right to change, limit or terminate any special offers or discounts at any time. Prices do not include delivery charges. Delivery is 14,99 EUR for shipping within the European Union. If you order products worth 100 EUR or more, shipping is for free. Delivery charges include VAT. The content of this website has been compiled with meticulous care. Yet, we do not guarantee that the prices or delivery charges shown on our website are correct.

VII. Statutory right of withdrawal
Consumers shall have a right of cancellation. A consumer is any natural person which concludes a legal transaction for a purpose that cannot be ascribed to a commercial or independent business activity.

Cancellation policy
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the date you, or a third party named by you, who is not the carrier, have/has taken possession of the products. To exercise your right of withdrawal, you have to inform us,

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not mandatory. To observe the revocation period it is sufficient to send off the revocation or dispatch the product in time.

Effect of withdrawal
If you withdraw from a contract of sale during the withdrawal period in accordance with our returns policy, we shall reimburse all payments we received from you, including delivery charges at the latest within fourteen days from the date on which the notification of withdrawal of this contract has been received by us. For this repayment we shall use the same method of payment that you used making the original transaction, unless we arrange a different method with you; you will not be charged any fees for such repayments under any circumstances. We may withhold reimbursement until we have received the returned products, or until you have submitted proof that you have returned the Products, whichever comes earlier.

*Exception: delivery charges shall not be reimbursed, in case you keep some of the products you ordered.

To observe the revocation period it is sufficient to send off the revocation or dispatch the product in time. The consumer shall not be charged for the direct cost of returning the goods. VIII. Voluntary return guarantee in addition to your statutory right of withdrawal
In addition and without prejudice to your statutory right of withdrawal, we grant you an additional voluntary return guarantee. This allows you to withdraw from the contract of sale, without specifying any reasons, for an additional 16 days beyond the withdrawal period. Hence, the total return period is 30 days.

IX. Methods of payment
You can pay by bank transfer oder with PAYPAL. PAYPAL offers the following payment methods: by PAYPAL acount, by bank transfer or by credit card (VISA, MASTERCARD, AMEX).
Payment is due 14 days after receiving your item(s).

X. Retention of title
All Products will remain the property of SANTA ANA athletic apparel GmbH until you have paid all amounts owed to us in full.

XI. Online dispute resolution

XIV. Final provisions
Statutory provisions apply in cases that are not covered in our terms. Should one or more provisions in these general terms and conditions be invalid or should this be the case in the future, this has no effect on the validity of the remaining provisions. Place of jurisdiction is Germany. Contract language is German. German law is exclusively applicable for the entire business relationship. The UN convention on contracts for the international sale of goods does not apply.
